1. Acceptance of Terms

Welcome to Taiba. By downloading, installing, or using the Taiba mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Taiba ("we", "us", or "our") regarding your use of the App.

2. Description of Service

Taiba is a prayer tracking application designed to help Muslims build consistent habits with their five daily prayers (Salah). The App provides:

• Prayer completion tracking for the five daily prayers
• Streak tracking and statistics
• Prayer reminders and notifications (optional)
• Data synchronization across devices (optional via iCloud)
• Personalized insights and guidance

3. Eligibility and User Accounts

The App is available to users of all ages. However, if you are under the age of 13, you must have your parent or legal guardian's permission to use the App.

No account registration is required to use the basic features of the App. Your data is stored locally on your device and, if enabled, synced via your Apple iCloud account.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App
• Use the App to transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• Reverse engineer, decompile, or disassemble the App or attempt to derive the source code
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) from the App

5. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Taiba, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App strictly in accordance with these Terms.

6. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

Key points about your data:

• Your prayer tracking data is stored locally on your device
• If you enable iCloud sync, your data is synced via Apple's iCloud infrastructure
• We do not sell, rent, or trade your personal information
• We do not use third-party analytics or advertising services

7. Subscription and Payments

Taiba currently offers its core features free of charge. If we introduce premium features or subscription plans in the future, the following terms will apply:

• All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple App Store account settings
• Refunds are handled in accordance with Apple's refund policies

8. Disclaimers

Religious Guidance: Taiba is a tool to help you track your prayers and build consistent habits. It is not a substitute for religious guidance or scholarly advice. For questions about Islamic practices, please consult with qualified religious scholars.

Prayer Times: While the App may provide prayer time information, you should verify prayer times with your local mosque or trusted Islamic authority. Prayer times can vary based on location and calculation methods.

App Availability: We strive to provide consistent and reliable service, but we do not guarantee that the App will be available at all times or that it will be error-free. The App is provided on an "as is" and "as available" basis.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Taiba shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of your data stored in the App
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted to or through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App

10. Indemnification

You agree to defend, indemnify, and hold harmless Taiba, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

You may terminate your use of the App at any time by deleting the App from your device. Upon termination, your right to use the App will immediately cease. If you wish to delete your data as well, you can do so through the App settings before uninstalling.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will notify you by:

• Displaying a prominent notice within the App, or
• Sending you a notification through the App or to your registered contact information

Your continued use of the App after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in the United States.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Taiba regarding the use of the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter herein.
